Digital Millennium Copyright Act (DMCA) Notice & Takedown Policy

At newest.cloud, we operate a content-promotion platform where creators, fans, and affiliates can share promotional materials, banners, and public links to their social or subscription profiles. We fully respect copyright law and the rights of content creators under the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c).

If you believe that material available on newest.cloud infringes upon your copyright, this page explains how to submit a proper takedown request — and what happens afterward.

1. Scope of Content

newest.cloud publishes and indexes a variety of materials, including:

  • User-submitted promotional posts, screenshots, banners, and links
  • Embedded or preview media from social platforms (e.g., OnlyFans, Fansly, Reddit, Instagram, X, RedGifs, FikFap, TikTok, Youtube, etc.)
  • Aggregated or automatically displayed thumbnails, metadata, or descriptive text

We do not host or store original subscription content, paywalled videos, or any files belonging to creators. Any promotional or preview material displayed is either user-submitted, publicly accessible, or embedded directly from third-party platforms.

If you believe any such material violates your copyright, you can file a DMCA notice as described below.

2. Filing a DMCA Takedown Notice

To submit a valid DMCA notice, you must provide the following written information:

  1. Your full legal name, company name (if applicable), and contact details (address, email, phone number).
  2. Clear identification of the copyrighted work you claim has been infringed.
  3. Specific identification of the material you believe is infringing, including the exact URL(s) on newest.cloud where it appears.
  4. A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
  6. Your electronic or physical signature.

Subject line: DMCA Takedown Request

3. What Happens Next

Once we receive a complete and valid DMCA request:

  • We will review and verify the claim.
  • If the content appears to infringe, we will remove or disable access to it.
  • We will notify the user who uploaded or submitted the material.
  • The user may then file a counter-notification if they believe the takedown was made in error.

4. Counter-Notification

If your content was removed in error or you believe the complainant misidentified the material, you may submit a counter-notification containing:

  1. Your name, address, telephone number, and email.
  2. Identification of the material that was removed and its prior location (the URL).
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  4. A statement consenting to the jurisdiction of the Federal District Court for your address (or where newest.cloud operates if outside the U.S.) and accepting service of process from the complainant.
  5. Your electronic or physical signature.

5. User Responsibility

All users submitting content to newest.cloud must ensure they have full rights or licenses to any materials they upload, link, or promote. By posting, you confirm that:

  • You own or are authorized to share the material.
  • You are not uploading any content behind a paywall or violating another platform’s Terms of Service.
  • You understand that false copyright claims or unauthorized uploads may result in removal, suspension, or permanent banning of your account.

6. Repeat Infringers

In accordance with the DMCA and general best practices, newest.cloud maintains a policy to terminate the accounts of repeat infringers. Users who receive multiple valid DMCA takedown notices may lose access permanently.

7. Limitation of Liability

newest.cloud acts as an online service provider under Section 512(c) of the DMCA.
We do not control user submissions or embedded media, and we are not responsible for verifying copyright ownership of materials uploaded or linked by users.

We comply in good faith with DMCA procedures, but we are not liable for damages resulting from the removal or disabling of access to allegedly infringing material.
